
Terms and Conditions - General terms and conditions for decoration and marriage proposal
We are very pleased that you are interested in our services. To ensure that your ideas and wishes are implemented in the best possible way, we would like to introduce our terms and conditions to you. Our primary goal is to create a unique and unforgettable atmosphere for your marriage proposal. For this, we offer both fixed packages on our website as well as tailored offers that are customized to your preferences.
The client commissions the agency Luxury Event Mallorca, represented by Mareike Jakél, to provide the decorative services described in the offer.
By paying the deposit, the client agrees to the terms and conditions, as well as the offer. The contract begins with the receipt of payment to Luxury Event Mallorca by Mareike Jakél.
Decorative Items:
The decorative items listed in the offer, such as vases, lanterns, cushions, torches, lighting, music box, etc., are rented and are not for purchase. In case of damage or loss of items, they must be replaced. The prices include the costs for delivery, organization, and cleaning. The flowers include both real and synthetic blooms (depending on the package). The fresh bouquet for your loved one is considered part of the package purchase and may of course be taken home.
Booking on Weekends (Saturday/Sunday) or Public Holidays:
For bookings on weekends or public holidays, an additional fee applies: from October to May, it is €80, and during the high season from June to September, it is €120.
Hourly Rate for Additional Services:
If additional services arise, such as booking a shuttle service or coordinating with photographers not from our portfolio, etc., the hourly rate will be €45 + VAT.
For spontaneous extension of the package time on-site, the hourly rate is €150 + VAT.
Location - Changing to Another Venue:
Our package includes free delivery to our recommended location. This location is near Palma (approximately 15 minutes away) directly by the sea. If we need to go to another location, there will be an additional charge: for a radius of up to 20 km from Palma: €50 travel fee + €100 location scout fee; for a radius of 20 - 70 km from Palma: €100 travel fee + €150 location scout fee.
Changes Due to Bad Weather (Packages from Our Website):
If the marriage proposal is planned outdoors and cannot take place due to bad weather, this must be discussed at least 1 day before the proposal. For rescheduling to an indoor location and another package, a service fee of €80 + VAT will be charged.
Changes Due to Bad Weather (Custom Packages):
If the marriage proposal is planned outdoors and cannot take place due to bad weather, this must be discussed at least 5 days before the proposal. For rescheduling to an indoor location and another package, a service fee of 10% of the order volume (minimum €100 + VAT) will be charged. If the new organization incurs significant effort, a separate fee will be discussed.
Own Location/Hotel/Finca/Access:
The client ensures that Luxury Event Mallorca by Mareike Jakél has access to the agreed locations and that sufficient time for setup and teardown is available.
Setup and Delivery:
The decoration will be delivered according to the agreement before the marriage proposal. Depending on the scope, at least 1-2 hours or more should be planned for setup. A similar amount of time should be considered for teardown.
Teardown/Pickup of Items:
Once the proposal has taken place, we have arranged a “time to enjoy” for you. Typically, this is 1 or 2 hours per package. The decoration will be dismantled after the agreed time. We will come to you once the time has passed. If you wish to leave earlier, please let us know. In that case, we will come and kindly ask you not to leave the items unattended.
Data Protection for Clients:
In accordance with the provisions of Law 15/1999, dated December 13, on the protection of personal data, the client is informed and explicitly agrees that their personal data will be stored in the electronic databases of Luxury Event Mallorca by Mareike Jakél, where the data will be kept confidential, subject to mandatory notifications.
This data will be used in accordance with the aforementioned law for the processing of the business and legal relationship between the parties and for the following purposes:
- Organization of event and decoration work, preparation of offers and invoices by Luxury Event Mallorca by Mareike Jakél and service providers, as well as general correspondence and communication.
The owner of the personal data consents to Luxury Event Mallorca by Mareike Jakél forwarding and disclosing the necessary data (name, address, tax number/ID number, etc.) to the respective service providers (catering, music, location, etc.) for the execution and provision of their respective services.
The provision of personal data is voluntary.
This agreement is valid indefinitely and can be revoked at any time for future purposes.
The revocation statement must be sent by the owner of the data in writing to Luxury Event Mallorca SL - Mareike Jakel.
Force Majeure:
Luxury Event Mallorca by Mareike Jakél is not liable for performance failures due to force majeure or circumstances beyond its control. It is also not liable for significant difficulties, risks, or impairments, especially those caused by unforeseen circumstances such as government actions, roadblocks, quarantine measures, entry restrictions, etc.
Liability:
The liability of Luxury Event Mallorca by Mareike Jakél – except in cases of intent and gross negligence – is excluded. Luxury Event Mallorca by Mareike Jakél is not responsible for loss or damage to items belonging to the client or guests.
Luxury Event Mallorca by Mareike Jakél is also not liable for third parties or commissioned companies. The client agrees to indemnify the agency from any claims for damages by third parties arising from or in connection with the organization/decorating of the event. All processes are coordinated to the best of our knowledge and belief.
Confidentiality:
Confidentiality applies to individual packages. The client also agrees not to disclose ideas, intellectual property, templates, and designs based on copyright to third parties and not to use them commercially.
Rescheduling and Cancellation for Fixed Packages from Our Website:
For rescheduling or cancellation up to 2 months before the agreed date, a fee of €80 + VAT will be charged.
Cancellation less than 2 months but up to 14 days before the marriage proposal will incur a fee of €160 + VAT. For rescheduling, a fee of €80 + VAT applies.
For cancellation less than 14 days before the planned proposal, a cancellation fee of €330 + VAT applies, as we have reserved the date exclusively for you. If you wish to reschedule, a processing fee of €120 + VAT will be charged.
For cancellations within 2 days of the marriage proposal, 80% of the order volume will be charged as a cancellation fee. The client will also cover costs that have already been incurred for purchases, etc. for the event.
If Luxury Event Mallorca proposes an alternative date and discusses it with you, the rescheduling will be free of charge.
Rescheduling and Cancellation for Custom Packages:
For rescheduling or cancellation up to 1 month before the agreed date, a fee of 10% of the order amount will be charged.
Cancellation less than 1 month but up to 14 days before the marriage proposal will incur a fee of 25% of the order amount. For rescheduling, a fee of 10% of the order amount applies.
For cancellation less than 14 days before the marriage proposal, a fee of 40% of the order amount will apply. For rescheduling, a fee of 20% of the order amount applies.
For cancellation within 2 days before the marriage proposal, 70% of the order volume will be charged as a cancellation fee. The client will also cover costs that have already been incurred for purchases, etc., for the event/decoration.
If Luxury Event Mallorca proposes an alternative date and discusses it with you, the rescheduling will be free of charge.
Termination:
The agency has the right to terminate the agreement if the client fails to make agreed partial payments on time or for an important reason.
Food and Drinks:
We provide food from restaurants or food markets. Luxury Event Mallorca by Mareike Jakél is not liable for the food. Any allergies or intolerances should be communicated by the client in advance via the questionnaire.
If something is not to the client’s taste, please inform us immediately when trying the food. The client agrees to release the contractor from any later complaints.
If a dish is difficult to consume due to dental issues, both the contractor and guests should take care when eating.
Disputes:
We always try to find a common solution and invite you to a harmonious discussion. In case this is not possible, the place of jurisdiction and fulfillment is Palma de Mallorca - Islas Baleares.
Final Provisions:
If one or more provisions of this agreement between Luxury Event Mallorca by Mareike Jakél and the client are or become invalid, this will not affect the validity of the other provisions or agreements. Instead of the invalid provision, a legally permissible arrangement will apply that reflects the economic sense and purpose of the invalid provision.
