
Terms and Conditions - General terms and conditions for decoration and marriage proposal
We are very pleased that you are interested in our services. To ensure that your ideas and wishes are implemented in the best possible way, we would like to present our general terms and conditions to you. Our highest goal is to create a unique and unforgettable atmosphere for your marriage proposal. For this purpose, we offer both fixed packages on our website as well as tailor made offers that are individually adapted to your wishes.
The client commissions the agency Luxury Home Mallorca SL, represented by Mareike Jakél, with the decorative services described in the offer.
By paying the deposit, the client agrees to the notes and the general terms and conditions as well as to the offer. The contract begins upon receipt of payment by Luxury Home Mallorca SL by Mareike Jakél.
Decoration items:
The decorative items listed in the offer, such as vases, lanterns, seat cushions, torches, lighting, music box, etc., are rented and are not considered a purchase price. Any items that are damaged or lost must be replaced. The prices include delivery, organization, and cleaning costs. The flowers include both real and synthetic blooms depending on the package. The fresh bouquet for your loved one is included as a purchase in the package and may of course be taken with you.
Weekend or public holiday booking (Saturday / Sunday):
For bookings on weekends or public holidays, an additional fee applies:
From October 20 to May 15: 80 €
High season from May 16 to October 14: 120 €
Hourly rate for additional services:
If additional services are required, such as booking a shuttle service or coordination with photographers not included in our portfolio, an hourly rate of 45 € + VAT will be charged.
For spontaneous extensions of the package time on site, the hourly rate is 150 € + VAT.
Location – travel to a different place:
Our package includes free delivery to our recommended location. This location is near Palma (approx. 15 minutes away) directly by the sea.
If we are required to travel to another location, the following additional costs apply:
Within a radius of up to 20 km from Palma: 50 € travel flat rate + 100 € location scouting
Within a radius of 20 to 70 km from Palma: 100 € travel flat rate + 150 € location scouting
Contact and coordination before the event:
To ensure all details are coordinated optimally, we ask the client to send a short message (for example via WhatsApp) at least two to three days before the agreed date. This allows us to provide final information regarding the schedule and meeting point in good time.
If no response is received up to 24 hours before the event and the client cannot be reached despite several contact attempts on our part, we can no longer guarantee the reserved date.
In this case, the appointment will be considered canceled, and the agreed service will be charged in full (100%), as we have reserved the date exclusively for the client and completed all preparations.
Changes due to bad weather – packages from our website:
If the marriage proposal is planned outdoors and cannot take place as intended due to weather conditions, we ask you to contact us at least 2 days before the date to discuss possible alternatives.
A rebooking to an indoor location and an adjusted package is generally possible. For the additional planning effort, we charge a service fee of 80 € + VAT.
Please note that a date change is considered a rebooking.
The date has been reserved exclusively for you, and we ask for your understanding that we have no influence on weather conditions.
Changes due to bad weather – individually created packages:
If the marriage proposal is agreed to take place outdoors and cannot be held due to bad weather, this must be discussed at least 5 days before the proposal date.
For a rebooking to an indoor location and a different package, a service fee of 10% of the order volume (minimum 100 € + VAT) will be charged.
If the new organization involves significant additional effort, the flat rate must be agreed upon separately.
Own location / hotel / finca / access:
The client ensures that Luxury Home Mallorca SL by Mareike Jakél has access to the agreed locations and that sufficient time is available for setup and dismantling.
Setup and delivery:
The decoration will be delivered as agreed before the marriage proposal. Depending on the scope, at least 1 to 2 hours or more must be planned on site for setup. Approximately 1 hour is also required for dismantling.
Dismantling / collection of items:
Once the marriage proposal has taken place, we provide a “time to enjoy” period for you. Depending on the package, this is usually 1 or 2 hours. After the agreed time, the decoration will be dismantled. We will come to you after the time has expired. If you wish to leave earlier, please inform us. We will then come to you, and we kindly ask that the items are not left unattended.
Confidentiality:
In general, confidentiality regarding fees applies to individual packages. The client also agrees not to pass on ideas, concepts, templates, and designs protected by copyright to third parties or to use them commercially.
Rebooking and cancellation – fixed packages from our website:
For fixed packages booked via our website, the following conditions apply:
a) Rebooking or cancellation up to 2 months before the agreed date:
A flat processing fee of 80 € + VAT will be charged, regardless of whether the booking is canceled or rebooked.
b) Cancellation between 2 months and 14 days before the date:
Cancellation fee: 160 € + VAT
Rebooking fee: 80 € + VAT
c) Cancellation less than 14 days before the date:
A cancellation fee of 330 € + VAT applies, as the date was reserved exclusively.
Rebooking within this period: processing fee of 120 € + VAT.
d) Cancellation from 7 days before the date:
From this point, 80% of the agreed order volume will be charged as a cancellation fee. In addition, the client must reimburse all costs already incurred related to the event (e.g. flowers, decoration, materials).
e) Cancellation less than 3 calendar days before the date:
In this case, the full amount (100%) of the booked service will be charged, as the date cannot be reassigned at short notice.
f) Goodwill arrangement for alternative dates proposed by Luxury Event Mallorca:
If Luxury Event Mallorca by Mareike Jakél offers an alternative date for organizational or weather related reasons and this is mutually agreed upon, the rebooking will be free of charge.
Rebooking and cancellation – individually created packages:
a) Rebooking or cancellation up to 2 months before the agreed date:
A processing fee of 10% of the agreed order value will be charged.
b) Cancellation between 2 months and 14 days before the date:
Cancellation fee: 30% of the order value
Rebooking fee: 10% of the order value
c) Cancellation less than 14 days before the date:
Cancellation fee: 70% of the order value
Rebooking fee: 20% of the order value
d) Cancellation from 3 days before the date:
From this point, 100% of the order value will be charged. In addition, all costs already incurred must be reimbursed, especially for custom materials, decorations, floral elements, logistics, or other services related to the event.
e) Goodwill arrangement for date changes by Luxury Home Mallorca SL:
If Luxury Event Mallorca by Mareike Jakél proposes an alternative event date and this is mutually agreed upon, the rebooking will be free of charge.
Termination:
Luxury Event Mallorca by Mareike Jakél is entitled to terminate the contract extraordinarily if agreed (partial) payments are not made on time or if another important reason exists that makes continuation of the contract unreasonable.
An important reason exists in particular if the client fails to cooperate despite repeated requests, is repeatedly unreachable, behaves rudely or disrespectfully toward the team or service providers, or otherwise seriously disrupts the relationship of trust.
In the event of justified termination, the claim for services already rendered and costs incurred remains valid.
Food and beverages:
We provide food from restaurants or supermarkets. Luxury Event Mallorca by Mareike Jakél assumes no liability for food. Allergies and intolerances must be communicated by the client in good time via the questionnaire.
If something does not meet expectations, the client must inform us immediately upon tasting. The client releases the contractor from subsequent complaints.
If a dish is generally difficult to eat due to dental issues, the contractor and guests are responsible for chewing carefully.
Data protection for clients:
In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD), the client is informed and expressly agrees that their personal data will be included in the processing systems of Luxury Home Mallorca SL – Mareike Jakél. The data will be treated confidentially and processed exclusively for lawful purposes.
Data is collected for the following purposes:
– Organization and execution of events
– Preparation and sending of offers and invoices
– General communication
– Sharing necessary data with service providers involved in the event
The client expressly consents to the transfer of necessary personal data to third parties where required to fulfill the contract.
Providing personal data is voluntary. Consent can be withdrawn at any time in writing to:

Force majeure:
Luxury Event Mallorca by Mareike Jakél is not liable for performance disruptions due to force majeure or circumstances beyond its control, including extreme weather conditions, official orders, government actions, roadblocks, quarantine measures, pandemic related restrictions, entry regulations, or similar events.
Liability:
Liability of Luxury Event Mallorca by Mareike Jakél is excluded except in cases of intent or gross negligence. No liability is assumed for loss or damage to personal items. No liability is assumed for third party companies. The client agrees to indemnify the agency from any third party claims.
Access to the booked location may involve uneven terrain. No liability is assumed for damages, injuries, or inconveniences arising from access. Use is at your own risk.
Disputes:
We will always try to find a mutual solution through open discussion. If this is not possible, the place of jurisdiction and fulfillment is Palma de Mallorca – Balearic Islands.
Final provision:
If any provision of this agreement becomes invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a legally permissible provision that most closely reflects its economic intent.
