AGB - General terms and conditions for decoration

We are very pleased that you are interested in our services.


To ensure that your ideas and wishes are implemented in the best possible way, we would like to present our General Terms and Conditions. Our primary goal is to create a unique and unforgettable atmosphere with our decoration packages.

We offer fixed packages on our website, or alternatively, we can create a customized offer tailored to your wishes.

The Client commissions the agency Luxury Home Mallorca SL, represented by Mareike Jakél, with the decorative services described in the offer.
By making the down payment, the Client agrees to the offer as well as the notes and these General Terms and Conditions of Luxury Home Mallorca SL. The contract begins with receipt of the down payment amounting to 50% of the agreed services. The remaining 50% must be paid no later than seven (7) days before the event, or, if otherwise agreed, on the day of the event prior to the start. If special purchases are required for the execution of the event, separate payment arrangements may be set out in the offer. Full payment is a prerequisite for the execution of the agreed services.


1) Rental of Decoration Items

All decoration items mentioned in the offer and/or provided on-site (e.g., vases, lanterns, seat cushions, torches, lighting, music box, etc.) are rented items only and not objects of purchase.
The prices stated include delivery, collection, setup, dismantling, organization, any necessary purchases, and cleaning of the decorative items.


2) Access to the Location

The Client ensures that Luxury Home Mallorca SL by Mareike Jakél has unrestricted access to the agreed location and relevant areas. Sufficient time slots for setup and dismantling must be provided. The Client must inform us in advance of the exact address and provide a local contact person.


3) Setup & Delivery

Delivery and setup of the decoration will take place as agreed prior to the start of the event. Depending on the scope of the decoration, setup may take at least 1–3 hours or more.


4) Dismantling & Collection

Dismantling will take place at the times agreed in the offer. The Client is obliged to ensure that all rented items are available in full and undamaged at the agreed time.

  • If items are missing during collection but reappear afterwards, they must be delivered at the Client’s own expense to the office of Luxury Home Mallorca SL in Palma within two (2) days. Alternatively, upon request and subject to availability, we can collect the items. In this case, a flat fee of €80 plus VAT will be charged, plus €0.80 per kilometer driven (from Palma).
  • If dismantling during the event has been agreed but would visually disturb the celebration, dismantling will take place later at a time coordinated with the Client (e.g., dismantling of certain elements after the wedding ceremony).
  • Waiting times at weddings: Two (2) hours of waiting time from the beginning of the ceremony are included in the offer. If our team needs to remain on-site longer, an additional fee of €45 plus VAT per hour and per staff member will be charged.


We recommend discussing the dismantling process with us in detail beforehand to ensure it is carried out according to your wishes.

  • For dismantling and return on the following day, a separate flat fee will be charged:
  • Within 20 km of Palma: €120 + VAT
  • 20–40 km from Palma: €180 + VAT
  • 40–70 km from Palma: €220 + VAT


5) Security Deposit

For orders exceeding €900, a deposit of €350 must be paid in advance for the rented decoration items. This deposit will be refunded upon the proper return of the items.


6) Flowers

Each flower arrangement we create for you is unique and the result of creative work. Due to the variety of flowers and shrubs, it is not possible to guarantee the exact appearance of an arrangement in advance. We will follow your preferences and the selection of available flowers to design individual and appealing arrangements.

We order flowers according to your specifications from our supplier. Please note that we cannot guarantee that the delivery will always be 100% correct, as this is beyond our control. However, we will do our utmost to ensure your order is properly fulfilled. Concrete flower orders must be submitted at least two (2) weeks before the event.
Depending on the package, flowers may include both natural and artificial blooms.


7) Music Box

If your package includes a music box:

To ensure smooth proceedings, the Client must ensure that no noise disturbances occur after 00:00.
The Client is responsible for compliance with Spanish and Balearic government regulations, particularly with regard to noise protection and decibel limits. Note: Music outdoors is legally permitted only until 23:00 or 00:00. After this time, the celebration must move indoors.


8) Protection of Items

The Client agrees to handle all rented items with care.

  • Items sensitive to moisture (e.g., music box, torches, LED elements, pampas grass, etc.) must be protected from rain and humidity and stored indoors overnight.
  • In case of heavy rain, the Client is obliged to protect or store items in time.
  • Sun-sensitive items (e.g., candles) must be protected from direct sunlight. LED candles or wax candles must not be left in the sun and should be removed at night so they are not exposed to sunlight the following morning.
  • Taper candles must be extinguished in time to avoid fire hazards and wax damage.


The Client is liable for any damage or loss resulting from improper handling, rain, sun, fire, candle wax, or other weather influences.

  • Cleaning & Damages: Minor stains (e.g., water spots, non-staining materials) will not incur additional costs. If chemical cleaning is required, costs will be invoiced separately. Please inform us upon return if major stains, losses, or damages have occurred. All damages or losses must be replaced by the Client.


9) Data Protection

The Client’s personal data will be handled confidentially by Luxury Home Mallorca SL by Mareike Jakél in accordance with applicable data protection laws (LOPD 15/1999) and used exclusively for the processing of the contractual relationship.

This includes event organization, offer preparation, invoicing, and necessary communication.
By entering into the contract, the Client agrees that the necessary data (e.g., name, address, tax number) may be shared with external service providers (e.g., catering, music, location) if required.
Consent may be withdrawn at any time with effect for the future in writing.


10) Force Majeure

Luxury Home Mallorca SL by Mareike Jakél is not liable for service disruptions due to force majeure or circumstances beyond our control. This also applies to significant difficulties, risks, or impairments caused by unforeseeable circumstances such as governmental restrictions, third-party interference, weather, road blockages, quarantine measures, or entry restrictions.

Setup of decorations will take place within the agreed time frame. If, due to weather conditions (e.g., sun exposure, rain, wind), it is not appropriate to place certain items immediately, they will be delivered and stored in a sheltered place. Placement at a later time will then be the responsibility of the Client.


11) Organizational Services

If your offer includes an organizational fee:

Luxury Home Mallorca SL by Mareike Jakél will obtain up to three (3) offers per service category. We recommend providers who have proven to deliver high-quality and reliable services. The agency will make every effort to organize requested external services conscientiously. However, responsibility for availability, fulfillment of special requests, or additional services lies with the respective external providers and their capacity. Especially for last-minute requests, availability cannot be guaranteed.

  • Additional Services: If tasks outside the agreed offer arise (e.g., shuttle service bookings, arrangements with photographers not in our portfolio, etc.), an hourly rate of €65 + VAT will be charged.


12) Catering for Staff

For working hours exceeding five (5) hours on the event day, the Client agrees to cover meals for the staff. Typically, this amounts to €30–50 per person.


13) Updates & Communication

The Client agrees to promptly communicate feedback, changes, or updates relevant to planning, supervision, or follow-up of decorations and to cooperate with necessary emails or calls with Luxury Home Mallorca SL by Mareike Jakél.

The Client must provide the final number of guests at least three (3) weeks before the event (if relevant for decoration). Seating plans or special requests must also be submitted at least three (3) weeks before the event.
Subsequent changes that increase workload will be charged at €45 + VAT per hour.


14) Liability

Luxury Home Mallorca SL by Mareike Jakél excludes liability for damages, except in cases of intent or gross negligence. Liability for loss or damage of items belonging to the Client or their guests is excluded.

The agency is also not liable for services or breaches of duty by third parties or subcontractors. The Client agrees to indemnify the agency from any third-party claims for damages in connection with the organization or decoration of the event.
All processes are coordinated to the best of our knowledge and belief, but no guarantee can be given for a flawless execution.


15) Torches / Candles / Fire

a) Torches:
If torches or real candles are included in the offer, Luxury Home Mallorca SL by Mareike Jakél will deliver and set them up as agreed. Supervision is the Client’s responsibility. The agency accepts no liability for fires or hazards arising from open flames. The Client must ensure safety during use.

Torches may only be lit outdoors (not under awnings, tents, or roofs), must be placed securely on a non-flammable surface (stone/concrete), never left unattended, and kept away from children and pets.
Torches must only be refilled with proper torch oil. Under no circumstances may flammable gels, gasoline, or other liquids be used (explosion risk).
Flames must always be extinguished with the lid/cover, never with water or by blowing.


b) Candle Wax:
Decoration items must only be transported after wax has fully cooled and hardened. If wax damages decoration items, a cleaning fee of €150 + VAT will be charged.


c) Fire Regulations:
Clients must comply with Spanish/Mallorcan laws regarding fire. Regulations vary by area and season. The relevant decree is Balearic Decree 125/2007, which is designed to prevent forest fires. In case of fire, authorities and the fire brigade must be notified immediately.


16) Confidentiality

All fee agreements are confidential. All ideas, concepts, templates, email drafts, and designs provided by the agency are protected by copyright and may only be used for the agreed purpose. Sharing or commercial use without written consent is prohibited.


17) Rebooking

A rebooking fee will be charged, as we reserve your date and decline other bookings.

  • More than 8 months before the event: free of charge.
  • Between 8–4 months before the event: 20% of the total contract value.
  • Less than 4 months before the event: 30% of the total contract value + costs already incurred for purchases.
  • Less than 4 months before the event (repeated clause in German): up to 70% depending on costs already incurred.
  • Within 4 weeks of the event: 100% of the total contract value.

Rebooking is subject to availability.


18) Cancellation

Up to 10 months before the event: cancellation possible with a fee of 30% of the total contract value.

Deposits are non-refundable, as we block your date and refuse other events. However, we may offer a one-time date change under the rebooking terms.

The agency reserves the right to cancel if agreed partial payments are not made on time, if the GTC are violated, if respectful conduct is not maintained, or for other serious reasons caused by the Client. In this case, costs will be charged at least equal to the deposit already paid.


19) Disputes

We will always strive to find a mutual solution through open communication. If this is not possible, the place of jurisdiction and performance is Palma de Mallorca – Islas Baleares.


20) Final Provisions

If any clause of this agreement between Luxury Home Mallorca SL by Mareike Jakél and the Client becomes invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a valid clause shall apply that comes closest to the intended economic purpose.
